Acceptance of Terms

Welcome to Sober Galaxy. These Terms of Use ("Terms") govern your access to and use of the Sober Galaxy mobile application, the sobergalaxy.com website, and any other related services (collectively, the "Service") operated by Sober Galaxy ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

These Terms of Use are in addition to our Privacy Policy and End User License Agreement, which also govern your use of our Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into these Terms;
• You are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country;
• You are not listed on any U.S. government list of prohibited or restricted parties;
• You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

If you are accessing or using the Service on behalf of a business, entity, or organization (collectively "Organization"), then you represent and warrant that you:

• Are an authorized representative of that Organization;
• Have the authority to bind that Organization to these Terms;
• Agree to these Terms on behalf of that Organization.

Account Registration and Security

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to disable any user account, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting User Content on or through the Service, you represent and warrant that:

• The User Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms;
• The posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person;
• The User Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

You retain any and all of your rights to any User Content you submit, post or display on or through the Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for User Content you or any third party posts on or through the Service.

By posting User Content using the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. You agree that this license includes the right for us to make your User Content available to other users of the Service, who may also use your User Content subject to these Terms.

We have the right but not the obligation to monitor and edit all User Content provided by users. We may remove any User Content at any time, for any reason, without notice.

Community Guidelines and Prohibited Activities

Sober Galaxy is committed to providing a supportive, positive environment for those pursuing a sober lifestyle. As a user of our Service, you agree to abide by the following community guidelines:

• Be Respectful: Treat others with kindness, respect, and empathy. Do not engage in harassment, bullying, or discriminatory behavior.
• Be Supportive: Our community is focused on supporting each other in sobriety. Encourage others in their journey.
• Maintain Privacy: Respect the privacy of other users. Do not share personal information about others without their explicit consent.
• Share Responsibly: Share content that is appropriate and relevant to the community's focus on sobriety and wellness.

In addition to the above guidelines, you agree not to:

• Use the Service in any way that violates any applicable local, state, national, or international law or regulation;
• Promote, encourage, or facilitate the use of alcohol, drugs, or other substances;
• Post content that glorifies or romanticizes substance use;
• Impersonate or attempt to impersonate Sober Galaxy, a Sober Galaxy employee, another user, or any other person or entity;
• Engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service);
• Attempt to circumvent any content-filtering techniques we employ;
• Develop any third-party applications that interact with the Service without our prior written consent;
• Use the Service for any purpose that is illegal or prohibited by these Terms.

Medical Disclaimer

Sober Galaxy is not a medical or treatment service. The information and content provided through our Service is for informational and support purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

We do not provide medical advice, detoxification services, substance abuse treatment, or mental health counseling. If you are experiencing a medical emergency, are in crisis, or need immediate help for addiction, please contact your doctor, emergency services, or a substance abuse helpline immediately.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or substance use. Never disregard professional medical advice or delay in seeking it because of something you have read or seen on our Service.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Sober Galaxy and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Sober Galaxy.

You acknowledge that all intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Service and its content are owned by Sober Galaxy or its suppliers.

Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to support@sobergalaxy.com, with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any content is infringing your copyright.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Sober Galaxy.

Sober Galaxy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Sober Galaxy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third-party websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service, or delete your account through the settings in your profile.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify, and hold harmless Sober Galaxy, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOBER GALAXY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOBER GALAXY ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY: (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR COURSE OF PERFORMANCE.

SOBER GALAXY, ITS SUBSIDIARIES, AFFILIATES, AND LICENSORS DO NOT WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
